Another episode of the dispute with Germany
PGE Górnictwo i Energetyka conventional (PGE GiEK) filed a cassation appeal against the judgment of the Provincial Administrative Court (WSA) in Warsaw, which in March overturned the environmental decision of the General Director for Environmental Protection (GDOŚ) regarding the continuation of coal mining in the Turów mine. Now the Supreme Administrative Court will decide on the case.
The case was initiated by complaints from ecologists and German local government officials from border areas regarding the environmental decision of the General Directorate for Environmental Protection of September 30, 2022. The decision of the General Directorate for Environmental Protection was partially annulled by the Warsaw Provincial Administrative Court in March this year.
In accordance with the written justification of the Provincial Administrative Court's judgment, the decision of GDOŚ did not take into account the provisions of the Agreement between the Government of the Republic of Poland and the Government of the Czech Republic of February 3, 2022. This agreement imposes on Poland the obligation to build an earth embankment along the southern border of the Turów mine, aimed at reducing the impact of the mine's operation on the territory Czech Republic, in particular regarding noise, light and air pollution.
The Provincial Administrative Court emphasized that the planned investment should take into account the provisions of this agreement, which include, among others: groundwater monitoring and construction of an earth embankment. It was also indicated that the legal status had changed at the stage of appeal proceedings in connection with the entry into force of this agreement.
PGE GiEK emphasized that all provisions of the Polish-Czech agreement are fulfilled properly and on time, which was confirmed by the Czech side.
The case of the Turów mine is still the subject of dispute and further court proceedings, and the decision of the Supreme Administrative Court will be crucial for the future of coal mining in this area.
